Guardianship

Guardianship is when the court designates a legal guardian for the person, their property or both. In the instance of guardianship of a child, a probate guardian is responsible for the child’s well-being and/or property until he or she reaches the age of 18. Guardianship may also refer to decisions regarding a person or the property of a person who has been declared incapacitated or is soon to be incapacitated. Third, it may refer to legal guardianship over the well-being or property of individuals with developmental disabilities or who are no longer able to take care for themselves because of lifelong development issues. There are two types of probate guardianship:

Guardianship of the Estate
This type of guardianship involves the regulation of an individual’s income, money, and property. It may also involve taking on the responsibility of debt management and other financial affairs;


Guardianship of the Person
This type of guardianship is set up when a person is assigned the responsibility to care for the physical wellbeing of an incapacitated individual. The guardian assumes responsibility of ensuring the individual is properly taken care of and is involved in important decision making for said individual.
